BIA Separations successfully defends its IP Position

On 28 June 2007, there was a hearing at the European Patent Office which confirmed the revocation of European Patent EP 0 765 183 B1 owned by GE Healthcare.

The claimed subject matter was providing a gap between a sample distributor and a monolithic separation medium. The Board of Appeal shared the view of the Opposition Division which held that the technology covered by EP 0 765 183 B1 was anticipated by the prior art, however, came to this conclusion based on written publications rather than prior public use as the Opposition Division held.
